On June 13, the Parliament adopted an Amendment, which tightens up conditions for executors´ activity. Prior to any legal actions, debtors will receive an obligatory warning asking them to pay their debt on their own free will. In some cases, several executions could be joined into one, what would decrease debtor’s costs.
In the course of executions, executors are supposed to take audio and video records. Disciplinary actions against executors will be stricter; may an executor distrain upon any item unlawfully, he will be obliged to return the respective item to its original place from where he took it.
As per the new procedure, in order to start the execution, an executor’s authorization received from court via e-mail will be sufficient. It is, however, very likely that it will not be any more possible to appeal against such a way of execution launch, as currently is the case.
Now the Bill is to be discussed and commented in Senate.
